In September we got an iPhone 16 pro max on a 2 year contract unfortunately this morning it bricked we have given it to someone to repair but we are wandering how to proceed if they don’t fix it are we left paying for a phone that won’t work ?

Ah no, I'm sorry to hear that.
As it is over the 30 day period, you would now be covered under the 12 month Apple warranty.
I'd recommend you reach out directly to Apple to check if you are covered.
