I have 3 months left of my contract I wanted to see if I can upgrade early as it states on the website there won't be a extra charge if its under so many days but would I have to trade in my current phone for my new contract

To determine for sure what options you have, you'd need to speak to the Support Team by calling or chatting with them. I believe the upgrade window opens somewhere in the region of 45 days before the end date of the current plan. In that time, you can upgrade without a fee. Before that, you'd had a fee to pay that covers the value of the plan up to its end date. 

The team should be able to confirm the dates, and how much it would cost if you choose to do it earlier.
